Your order represents a request to enter into an agreement with us. A purchase<br \/>\nagreement has been reached when you have made an order to purchase an item from the website and received an order<br \/>\nconfirmation via e-mail containing full details of your order. We will dispatch the item(s) to you by stated<br \/>\nshipping company. We shall remain owner of all items until such time as you have made full payment, and we have<br \/>\nreceived your payment.<\/p>\n<h4>PRICES<\/h4>\n<p>Our prices may be modified without prior notice further to circumstances beyond our control, such as significant<br \/>\nchanges in raw-material prices, exchange-rate fluctuations or changes made to value added tax. All prices include<br \/>\nvalue added tax of 25% within the European Union (EU). Freight costs are in addition if no other agreement had been made. Upon the<br \/>\nreturn of items, a refund will be made to the credit card or bank card account used when you made your order. We also ask you to note that our products are not intended to<br \/>\nbe used by people under age 12.<\/p>\n<h4>LIABILITY<\/h4>\n<p>We will not accept liability should an item you have purchased be used in a non-prescribed way. Happy Ears AB takes no responsibilities if<br \/>\nthe item is handled irresponsibly or without caution.<\/p>\n<h4>FORCE MAJEURE<\/h4>\n<p>We decline all liability for delivery delays or shortcomings in our fulfillment of obligations and commitments<br \/>\naccording to these purchase terms and conditions should the delivery delay or shortcoming be due to circumstances<br \/>\nbeyond our control and that prevent, obstruct or delay the delivery or fulfillment in question.\u2028\u2028 Circumstances<br \/>\nconsidered beyond our control include regulations, measures or omissions by public authorities, new or amended<br \/>\nlegislation, labour-market disputes, blockade, fire, flooding, sabotage or major accidents. Such circumstances<br \/>\nshall also include decisions by public authorities that may negatively affect the market or products, such as<br \/>\ndecisions regarding warning texts, sales prohibition and similar, or an abnormal downturn in the market.<\/p>\n<h4>RIGHT OF EXCHANGE<\/h4>\n<p>As customer, you have the right to exchange your item(s) for an equivalent product within 7 days of receipt of the<br \/>\nitem(s), although the right of exchange shall not apply to sales and special-offer products. In order for a return<br \/>\nto be approved, the item(s) must be returned unopened in their original condition and in their original packaging<br \/>\ntogether with all related information and parts. The return must be made with the same wrapping as when it was<br \/>\nreceived, or with equivalent wrapping. At exchange of purchased item(s), the cost of return freight will be borne<br \/>\nby the customer.<\/p>\n<h4>COMPLAINTS<\/h4>\n<p>Should the item(s) be damaged upon receipt, or should you receive an incorrect product, or should the item(s) in any<br \/>\nother way deviate from the agreement between yourself and us, you shall have the right to submit a complaint.<br \/>\nComplaints concerning an item must be submitted as soon as possible. A complaint submitted within 1 weeks of a<br \/>\nfault being discovered will always be considered as being made within the permitted period of time. As soon as a<br \/>\nreturned item has been received in accordance with what is set forth above under &#8220;Right to purchase cancellation<br \/>\nand return of item(s)&#8221;, a refund will be made to you within 30 days of us having received your complaint and return<br \/>\nof the product. Your right to submit a complaint against a purchased item is governed by the rules applicable<br \/>\naccording to the laws of the country from which you have placed your order. Your right to submit a complaint<br \/>\nagainst a purchased item will, however, never exceed 1 years. Should the product be faulty, defective or should you<br \/>\nhave received the wrong item, the cost of return freight will be borne by us.<\/p>\n<h4>LIABILITY UPON RETURN OF GOODS<\/h4>\n<p>When using the right to purchase cancellation or right to submit a complaint or right of exchange, you shall be<br \/>\nliable for the returned item(s) during the return shipment, and you shall thereby be liable to compensate us for<br \/>\nitem(s) returned should such item(s) be damaged or lost during the return shipment. In view of that you are liable<br \/>\nfor the returned item(s) until they have been received by us, we recommend that you make a note of the parcel&#8217;s<br \/>\ntracking number.<\/p>\n<h4>DELIVERY<\/h4>\n<p>If you have not received your order within 30 days, you shall have the right to\u00a0cancel the purchase at no\u00a0cost<br \/>\nshould you not accept the proposed new delivery date. Refund of your payment will be\u00a0made within 30 days of us<br \/>\nreceiving your notice of purchase cancellation.\u2028\u2028 You will be informed by email when the\u00a0item(s) are ready for collection.<br \/>\nWe will charge for parcels that are not collected, in order to cover\u00a0administrative and freight costs (shipment to and from).<br \/>\nThe related invoice will be sent within 30 days of the<br \/>\nuncollected parcel being registered with us.<\/p>\n<h4>SHIPMENT<\/h4>\n<p>We are liable for items that are damaged or lost during delivery.
