Your order represents a request to enter into an agreement with us. A purchase\u00a0agreement has been reached when you have made an order to purchase an item from the website and received an order\u00a0confirmation via e-mail containing full details of your order. We will dispatch the item(s) to you by stated\u00a0shipping company. We shall remain owner of all items until such time as you have made full payment, and we have\u00a0received your payment.<\/p>\n<h4>PRICES<\/h4>\n<p>Our prices may be modified without prior notice further to circumstances beyond our control, such as significant<br \/>\nchanges in raw-material prices, exchange-rate fluctuations or changes made value added taxes. All prices include\u00a0value added tax within the European Union (EU). Value added taxes of 25% is also included to all purchases in Norway. \u00a0Should the rate of the value added taxes be modified, we reserve\u00a0the right to adjust our prices with the equivalent amount. Sales on the website is intended for non business consumers. It&#8217;s not possible to send invoices with a customer VAT number. For larger business orders please email us at b2b@happyearsearplugs.com.<\/p>\n<h4>CHARGES<\/h4>\n<p>Current charges are available on our website www.happyearsearplugs.com.<\/p>\n<h4>SALES AND SPECIAL OFFERS<\/h4>\n<p>Sales and other special offers shall only be valid while the related stocks last, unless otherwise stated in<br \/>\nconjunction with the offer.<\/p>\n<h4>PAYMENT<\/h4>\n<p>Payment shall be made by charge card. Freight costs are in addition if no other agreement had been made. Upon the\u00a0return of items, a refund will be made to the credit card or bank card account used when you made your order. We\u00a0accept PayPal, Visa, American Express and Mastercard.<\/p>\n<h4>MINORS<\/h4>\n<p>Minors (children below 18 years of age) must have a parent&#8217;s or guardian&#8217;s approval to be able to order item(s) from\u00a0the website or by contacting us at info@happyears.co. We also ask you to note that our products are not intended to\u00a0be used by people under age 12.<\/p>\n<h4>LIABILITY<\/h4>\n<p>We will not accept liability should an item you have purchased be used in a non-prescribed way. In this regard, we\u00a0refer to the instructions provided upon the purchase of our products. You should therefore carefully read the\u00a0instructions before starting to use the item that you have purchased. Happy Ears AB takes no responsibilities if\u00a0the item is handled irresponsibly or without caution.<\/p>\n<h4>FORCE MAJEURE<\/h4>\n<p>We decline all liability for delivery delays or shortcomings in our fulfillment of obligations and commitments\u00a0according to these purchase terms and conditions should the delivery delay or shortcoming be due to circumstances\u00a0beyond our control and that prevent, obstruct or delay the delivery or fulfillment in question. Circumstances\u00a0considered beyond our control include regulations, measures or omissions by public authorities, new or amended\u00a0legislation, labour-market disputes, blockade, fire, flooding, sabotage or major accidents. Such circumstances\u00a0shall also include decisions by public authorities that may negatively affect the market or products, such as\u00a0decisions regarding warning texts, sales prohibition and similar, or an abnormal downturn in the market.<\/p>\n<h4>RIGHT OF EXCHANGE<\/h4>\n<p>As customer, you have the right to exchange your item(s) for an equivalent product within 30 days of receipt of the\u00a0item(s), although the right of exchange shall not apply to sales and special-offer products. In order for a return\u00a0to be approved, the item(s) must be returned unopened(except one Discovery Pack per customer) in their original condition and in their original packaging\u00a0together with all related information and parts. The return must be made with the same wrapping as when it was\u00a0received, or with equivalent wrapping. At exchange of purchased item(s), the cost of return freight will be borne\u00a0by the customer.<\/p>\n<h4>COMPLAINTS<\/h4>\n<p>Should the item(s) be damaged upon receipt, or should you receive an incorrect product, or should the item(s) in any\u00a0other way deviate from the agreement between yourself and us, you shall have the right to submit a complaint.\u00a0Complaints concerning an item must be submitted as soon as possible. A complaint submitted within one weeks of a\u00a0fault being discovered will always be considered as being made within the permitted period of time. As soon as a\u00a0returned item has been received in accordance with what is set forth above under &#8220;Right to purchase cancellation\u00a0and return of item(s)&#8221;, a refund will be made to you within 30 days of us having received your complaint and return\u00a0of the product. Your right to submit a complaint against a purchased item is governed by the rules applicable\u00a0according to the laws of the country from which you have placed your order. Your right to submit a complaint\u00a0against a purchased item will, however, never exceed one years. For instructions regarding submitting a complaint,\u00a0please contact our customer service at info@happyears.co. Should the product be faulty, defective or should you\u00a0have received the wrong item, the cost of return freight will be borne by us.<\/p>\n<h4>LIABILITY UPON RETURN OF GOODS<\/h4>\n<p>When using the right to purchase cancellation or right to submit a complaint or right of exchange, you shall be\u00a0liable for the returned item(s) during the return shipment, and you shall thereby be liable to compensate us for\u00a0item(s) returned should such item(s) be damaged or lost during the return shipment. In view of that you are liable\u00a0for the returned item(s) until they have been received by us, we recommend that you make a note of the parcel&#8217;s\u00a0tracking number.<\/p>\n<h4>DELIVERY<\/h4>\n<p>If you have not received your order within 30 days, you shall have the right to\u00a0cancel the purchase at no\u00a0cost\u00a0should you not accept the proposed new delivery date. Refund of your payment will be\u00a0made within 10 days of us\u00a0receiving your notice of purchase cancellation.\u2028\u2028 You will be informed by email when the\u00a0item(s) are ready for collection.\u00a0We will charge for parcels that are not collected, in order to cover\u00a0administrative and freight costs (shipment to and from).\u00a0The related invoice will be sent within 30 days of the\u00a0uncollected parcel being registered with us.<\/p>\n<h4>SHIPMENT<\/h4>\n<p>We are liable for items that are damaged or lost during delivery. Claims regarding items damaged during shipment\u00a0must be made in accordance with what is set forth under &#8220;Complaints&#8221; above.<\/p>\n<h4>DISCLAIMER<\/h4>\n<p>We do not accept liability for any printing or typing errors with regard to prices and other information provided\u00a0by us.<\/p>\n<h4>DISPUTES<\/h4>\n<p>Swedish law applies to all purchases and orders, unless otherwise expressly stipulated in these purchase terms and\u00a0conditions. Any dispute that may arise will be referred to the Swedish National Board for Consumer Disputes (Sw.\u00a0Allm\u00e4nna Reklamationsn\u00e4mnden \u2013 ARN).
